1. Agreement to Terms

Welcome to Dan Scott Painting. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Dan Scott Painting ("we," "us," or "our"), concerning your access to and use of our website and painting services.

By accessing our site or hiring us for services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the site and must discontinue use immediately.

2. Painting Services & Estimates

A. Estimates

All estimates provided are based on a visual inspection of the property and the specific scope of work discussed. Estimates are valid for 30 days from the date of issuance. Unforeseen conditions (e.g., dry rot, hidden water damage) discovered after work begins may result in additional costs, which will be documented in a written Change Order.

B. California Right to Cancel

Three-Day Right to Cancel

You, the buyer, have the right to cancel any home improvement contract at any time prior to midnight of the third business day after the date of the transaction. Cancellation must be done in writing.

3. Payments and Billing

To comply with California Contractors State License Board (CSLB) regulations:

  • Down Payments: We do not ask for or accept a down payment that exceeds $1,000 or 10% of the contract price, whichever is less.
  • Progress Payments: Payment schedules will be outlined in your specific contract. Payments are due upon completion of defined stages of work.
  • Final Payment: The final balance is due upon substantial completion of the project and your satisfaction walk-through.

4. SMS/Text Messaging Terms

By providing your phone number to Dan Scott Painting, you verify that you are the owner of that number and consent to receive text messages (SMS) from us regarding your painting project.

  • Purpose: Messages will be limited to quotes, scheduling, project updates, and appointment reminders.
  • Frequency: Message frequency varies based on your project status.
  • Rates: Standard message and data rates may apply depending on your mobile carrier.
  • Opt-Out: You may opt-out of receiving text messages at any time by replying STOP to any message we send.
  • Help: For assistance, reply HELP or contact us directly at (530) 410.1317.

Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

5. User Responsibilities

To ensure a successful project, you agree to:

  • Provide access to the property during agreed-upon working hours (typically Mon-Fri, 8am-5pm).
  • Remove personal items, breakables, and valuables from the work area before our team arrives.
  • Secure pets away from the work area for their safety and ours.
  • Ensure water and electricity are available for our use during the project.

6. Intellectual Property

Unless otherwise indicated, the website and its content (source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics) are owned or controlled by us and are protected by copyright and trademark laws.

7. Limitation of Liability

To the fullest extent permitted by California law, Dan Scott Painting shall not be liable for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.

Notwithstanding the foregoing, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the services during the six (6) month period prior to any cause of action arising.

8. Dispute Resolution

Binding Arbitration: Any dispute or claim arising in any way from your use of our services or website, except for disputes relating to the enforcement of our intellectual property rights, will be resolved by binding arbitration, rather than in court.

Class Action Waiver: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Changes to Terms

We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the website. Your continued use of our services or website constitutes your acceptance of the new Terms.
